How does the Australia Spouse Visa Work?

An Australian Spouse or Partner Visa permits the spouse or de facto partner of an Australian permanent resident, citizen or qualifying New Zealand citizen to relocate.

  • Temporary residence in Australia is permitted for a spouse or de facto partner of an Australian citizen or permanent resident, as well as for a citizen of New Zealand who meets the eligibility requirements. A Permanent Partner visa subclass 100 is the initial stage in the process of obtaining this visa.

However, to apply for a temporary partner visa, the applicant’s spouse or partner must be residing outside of Australia.

  • A spouse or de facto partner of an Australian citizen or permanent resident, or an eligible New Zealand citizen, may relocate to Australia permanently with this visa. The Partner (temporary) visa 309 is required for visa subclass 100.

Eligibility criteria- Australia Spouse Visa

Both the sponsor and the sponsored partner must fulfil the following eligibility conditions to be eligible for an Australian spouse visa:

  • To get married in Australia, you and your partner or spouse must be committed to a shared life together as a legally married couple or a de facto partner.
  • You both must provide evidence of a genuine relationship.
  • Prove that you live together or don’t live apart permanently, and you both must be 18 years of age or older when the visa is granted (for Visa 309).
  • To be sponsored partner or spouse must be outside Australia when applying and when the visa is approved (for Visa 309) (for Visa 100).
  • A sponsor must be an Australian citizen or a permanent resident.

Documents Required for Australian Spouse Visa

At various stages, you’ll need to collect and submit the following paperwork:

  • Identification Proof
  • A valid passport or equivalent means of international travel
  • Relationship Proof, such as:
  • A divorce decree, a death certificate (if the spouse was previously divorced/separated/widowed), or other documentation showing the couple’s legal status as husband and wife are all acceptable forms of evidence of marital status.
  • Financial data, including bank accounts, insurance policies, property documents, etc. should be submitted with a written declaration about the connection.
  • As a pair, you may get invitation cards, family pictures, joint vacation arrangements, etc., as evidence of how your family views your relationship.
  • If you’re in a de-facto relationship, you’ll need to show that you’ve been living together for at least a year before submitting your application.
  • Medical and criminal records
  • The documentation provided by the sponsor
